Terms of Service for Scratch Arts Australia

AGREEMENT TO TERMS
These Terms of Service constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and Scratch Arts Australia (“we,” “us,” or “our”), concerning your access to and use of the www.scratcharts.com.au website as well as any other media form, media channel, mobile website, or mobile application related, linked, or otherwise connected thereto (collectively, the “Site”).

You agree that by accessing the Site and purchasing our products, you have read, understood, and agree to be bound by all of these Terms of Service. If you do not agree with all of these Terms of Service, then you are expressly prohibited from using the Site and you must discontinue use immediately.

1. INTELLECTUAL PROPERTY RIGHTS
Unless otherwise indicated, the Site is our proprietary property and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Site (collectively, the “Content”) and the trademarks, service marks, and logos contained therein (the “Marks”) are owned or controlled by us or licensed to us, and are protected by Australian and international copyright and intellectual property laws.

2. USER REPRESENTATIONS
By using the Site, you represent and warrant that:

  • All registration information you submit will be true, accurate, current, and complete.
  • You are at least 18 years of age, or the age of majority in your state or territory of residence, to purchase any products that include sharp tools (e.g., scratch knives, styluses).
  • You will not access the Site through automated or non-human means, whether through a bot, script, or otherwise.
  • You will not use the Site for any illegal or unauthorized purpose.

3. PROHIBITED ACTIVITIES
You may not access or use the Site for any purpose other than that for which we make the Site available. Prohibited activities include, but are not limited to:

  • Unauthorized framing or linking to the Site.
  • Engaging in any data mining or similar data gathering or extraction methods.
  • Circumventing, disabling, or otherwise interfering with security-related features of the Site.
  • Using the Site in a manner inconsistent with any applicable laws or regulations.

4. PRODUCTS, ORDERS AND PAYMENT

  • Product Information: We endeavour to display our products and their colours as accurately as possible. However, the actual colour you see will depend on your monitor and we cannot guarantee it will be accurate.
  • Age-Restricted Items: The purchase of certain products (e.g., scratch knives, sharp tools) is restricted to persons aged 18 years and over. By purchasing these items, you confirm you meet this age requirement. We reserve the right to cancel any order that we believe violates this term.
  • Pricing & Availability: All prices are in Australian Dollars (AUD) and include Goods and Services Tax (GST) where applicable. We reserve the right to discontinue any product at any time. We cannot guarantee that all products will be available at the time of your order.
  • Order Acceptance: Your order constitutes an offer to us to buy the products. All orders are subject to acceptance by us, and we will confirm such acceptance by sending you an Order Confirmation email.

5. RETURNS, REFUNDS AND AUSTRALIAN CONSUMER LAW
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and for compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

6. SAFETY AND USE OF PRODUCTS
Our products may include sharp tools intended for artistic creation. By purchasing our products, you agree:

  • To use all tools, especially sharp implements, with extreme care and caution.
  • That children should only use sharp tools under direct adult supervision.
  • That you assume all risks associated with the use of our products, including the risk of injury.
  • That Scratch Arts Australia is not liable for any injury, damage, or loss resulting from the misuse or improper handling of our products.

7. GOVERNING LAW
These Terms of Service and your use of the Site are governed by and construed in accordance with the laws of the State of [Your State, e.g., New South Wales], Australia, and you irrevocably submit to the exclusive jurisdiction of the courts in that State.

8. DISCLAIMER
THE SITE AND PRODUCTS ARE PROVIDED ON AN AS-IS AND AS-AVAILABLE BASIS. YOU AGREE THAT YOUR USE OF THE SITE AND OUR PRODUCTS WILL BE AT YOUR SOLE RISK.
